RESUMEN

El hecho de que en un buen número de países del entorno europeo se prohíba la gestación por sustitución no ha atemperado la voluntad de muchas personas o familias de tener descendencia mediante el recurso a esta técnica reproductiva, expatriándose temporal­mente y asumiendo elevados costes económicos en aras de la materialización de su deseo. Se ha provocado así, incluyendo el siempre complejo elemento de la internacionalidad, la irrupción en los debates jurídicos nacionales de cuáles habrían de ser los efectos y conse­cuencias que se derivarían de esta praxis. Aspecto que también ha alcanzado, con carác­ter primario, a las prestaciones de Seguridad Social. De modo singular, a las prestaciones o permisos por maternidad. Se analizan aquí los pronunciamientos del TJUE recaídos sobre esta materia y su inci­dencia en el ordenamiento jurídico interno.

ABSTRACT
