ABSTRACT: The most recent cases of the European Court of Justice
about collective redundancies have shown important disagreements between
Directive 98/59/EC and the inadequate transposition made by art. 51 ET. Until now,
courts have tried to resolve, as far as they can, these legal maladjustments.
In order to this, courts have made a remarkable implementation of the principle
of conforming interpretation because of the legislator’s passivity, which has
left to courts the determination of such relevant concepts as what does dismissal
mean, or the need to consider the workplace as a measuring unit in order to
calculate the number of contract terminations.
