La impugnación de la extinción individual del contrato de trabajo del trabajador afectado por un despido colectivo tras las últimas sentencias del Tribunal de Justicia

RESUMEN:
La más reciente jurisprudencia del Tribunal de Justicia en materia de despidos
colectivos, al tiempo que reformula determinados elementos de la interpretación
tradicional del art. 51.1 ET, abre una importante puerta al trabajador si se
combina con las posibilidades que le ofrece el art. 124.13 LRJS. Con ambos
elementos, se incrementa la posibilidad de que un trabajador pueda impugnar un
despido colectivo a través de la impugnación de la extinción individual de su
contrato de trabajo. No obstante, se trata de un camino complejo, en el que se
suman importantes dificultades. Por un lado, las sustantivas, derivadas de la
nueva interpretación del despido colectivo; y, en segundo lugar, las
procesales, producto de la combinación de una vía de impugnación colectiva
junto con otra individual, así como por la escasa articulación que de ellas
ofrece el art. 124 LRJS. En este trabajo se tratará de exponer alguna de las
complejidades a las que puede enfrentarse el trabajador que ha visto extinguido
su contrato, pero se considera víctima de un despido colectivo en aplicación de
los criterios fijados por Rabal Cañas o Pujante Rivera.

ABSTRACT: The
most recent case-law on collective redundancies, while reformulating certain
elements of the traditional understanding of art. 51.1 ET, opens an important
door to the worker if combined with the possibilities offered by the art.124.13
LRJS. With both of them, the possibility that a worker may challenge a
collective redundancy through the challenge of the individual termination of
his own employment contract increases. However, it is a complex path, where
important difficulties add up. On the one hand, substantive, arising from the
new interpretation of the collective redundancy; and, secondly, procedural,
product of the combination of a collective challenge system with another
individual, as well as of the poor articulation of them given by art. 124 LRJS.
This paper will attempt to explain some of the complexities that an employee
may found after he has seen terminated his contract, but he considers
himself the victim of a collective redundancy under the criteria set by Rabal
Cañas or Pujante Rivera.
